The Battlefield Society filed a lawsuit on Friday calling on local courts to reverse the decision of the Delaware and Raritan Canal Commission that allows IAS to construct in stream corridors. The project was approved by default after the DRCC was unable to take any action within 45 days.
In March, the Regional Planning Board gave final approval to the IAS construction, despite the protest of the Battlefield Society. In July, the Battlefield Society appealed that decision, and it said it will file another lawsuit claiming that the housing construction would violate the Clean Water Act.
