Editorial: Opposing discrimination

In his 1996 dissent in Romer v Evans, Justice Scalia argues:

“But I had thought that one could consider certain conduct reprehensible — murder, for example, or polygamy, or cruelty to animals — and could exhibit even ‘animus’ toward such conduct.”

    Thank you for this. This is an eminently reasonable editorial, and I hope it does a lot to calm tempers on both sides of this quarrel.

    I should add that as an attendee at this lecture and a supporter of gay rights, I think this editorial accurately captures the reasoned (though controversial) position Scalia articulated.

    Does "recuse" mean "we disagree" or does half the Edits board have some kind of conflict of interest in talking about judicial philosophy? Seriously, this looks either like you don't know what "recuse" means or you all hold stock in Scalia, Inc.

    Gays getting married goes not

    Duncan should have quoted from other decisions when Scalia defends why people wouldn't want to be around gays.

    This editorial EXACTLY supports the point Duncan was trying to make.

    He said it is defensible and legitimate to argue the constitution doesn't protect gay rights, a position he personally disagrees with, but that Scalia went to far with his language.

    I assume it is the same '13 that has posted "MURDER KILLS PEOPLE Gays getting married does not". This is not an argument. You apparently think this is a solid enough comment to have posted it on every single hosie article. It's not.
